LCS Members Club T's & C's

General terms: 

 

  1. In these terms and conditions, unless the context indicates differently: 
    • "PI" means Personal Information as defined in the Protection of Personal Information Act 4 of 2013 ("POPIA") and "Process / Processing" has the same meaning assigned thereto in POPIA; 
    • “Le Coq Sportif”, “LCS”, “we”, “us” and “our” means Umnyama Nkukhu Sportswear (Pty) Ltd.  
    • “Websites” means https://lecoqsportif.co.za/  
    • “you” and “your” means the person who has agreed to participate in the LCS Members Club and become a member. 
  2. The LCS Members Club is run and managed by LCS. 
  3. LCS, its organisers, promoters, partners and agencies are not responsible for any loss, damage, injury, accident, or death that may arise from inclusion or participation in LCS Members Club. 
  4. LCS reserves the right to make changes to LCS Members Club in our sole discretion. 
  5. These terms and conditions may be updated from time to time. You will be bound by any updated terms and conditions. LCS Members Club may only be used in accordance with these terms and conditions. Please visit the Websites for more information and the latest terms and conditions. 
  6. LCS reserves the right to terminate the LCS Members Club at any time. In such event, we will provide notice to you. 
  7. LCS Members Club is only available at official LCS South African listed stores on https://lecoqsportif.co.za/
  8. LCS Members Club benefits and vouchers cannot be used or redeemed at https://lecoqsportif.co.za/  

 

Membership 

 

  1. To participate in the LCS Members Club and become a member, register at the till of any LCS store 
  2. Joining is free, and no membership fees are charged. 
  3. You must be 18 years or older and permanently reside in South Africa. 
  4. In the event that you wish to cancel your membership to LCS Members Club, please contact LCS Customer Services on 012 345 4527 or online@lcs.co.za

 

Your LCS Members Club card and profile 

 

  1. You will be issued with either a digital or a plastic LCS Members Club card, which remains the property of LCS. We reserve the right to issue, re-issue, decline and withdraw the LCS Members Club card and/or your membership at any time in our sole discretion, but we will not exercise this discretion unreasonably. 
  2. Your LCS Members Club card is not transferrable. 
  3. If you do not have your card with you when you shop at a LCS store, you will be able to look up your LCS Members Club profile at the till using your ID number, instead of your plastic or digital LCS Members Club card. 
  4. If your card has been lost or stolen, it is your responsibility to contact LCS Customer Services and request that your card be blocked. A replacement may be issued on request and any vouchers on the lost/stolen card will be transferred to the replacement card. 

 

Participating countries: 

 

  1. LCS Members Club is currently offered in all LCS stores throughout South Africa. 
  2. Further territories may be added or removed from time to time. 

 

Personal information: 

 

  1. This paragraph on PI must be read with LCS  Privacy Statement, which can be found at https://lecoqsportif.co.za/policies/privacy-policy.  
  2. How we may process your PI: 
    a. For as long as you are a LCS Members Club member, you expressly agree that: 
    i. we may collect and retain your PI for the purposes of opening, managing and maintaining your LCS Members Club membership and establishing and verifying your identity, and to enable us, and any of our authorised representatives to fulfil our obligations in relation to LCS Members Club; 
    ii. we may make any enquiry to confirm and verify any information provided by you to us at any stage; 
    iii. you will give us honest, accurate and up-to-date PI and maintain and update such information where necessary; 
    iv. we may maintain and store your PI for as long as we need to by law or for any lawful purpose provided for in POPIA; 
    v. you have the right to access your PI held by us, during office hours within a reasonable time after we have received such a written request for access 
    vi. Please also refer to our PAIA Manual available on the Websites for the process to request access to certain records which we may hold about you; 
    vii. you have the right to request us to correct or delete your PI that is inaccurate, irrelevant, excessive, out of date, incomplete, misleading or obtained unlawfully; 
    viii. you have the right to object to the processing of your PI at any time, in which event we will no longer be able to manage your LCS Members Club membership, and you will no longer be registered with LCS Members Club; 
    ix. you may be subject to a decision, which results in legal consequences for yourself or which affects you to a substantial degree, which is based solely on the basis of automated processing of your PI. You may make representations to us about a decision made in this regard; and 
    x. we may transfer your PI to a third party who is in a foreign country for purposes of maintaining your LCS Members Club membership. We will endeavour to transfer your PI to countries which offer at least the same level of protection as POPIA and/or the transfer is in terms of an agreement which provides an adequate level of protection. 
    b. You expressly consent that we may share your PI with: 
    i. registered credit bureau(x); 
    ii. our service providers, agents and sub-contractors that have been contracted by us; 
    iii. persons to whom we cede our rights or delegate our authority to, without your consent and without notice to you; and 
    iv. third parties for the express purpose of them marketing their services and products to you, when you have consented thereto as per clause 6 below. 
    c. You acknowledge and expressly consent that we may process your PI for purposes of: 
    i. processing your purchasing information and online browsing behaviour for: market and product analysis; customer analysis; monitoring your buying patterns; using credit bureau data to enrich your profile to enable us to improve our personalised marketing offers to you; and generating statistical and research reports for LCS use. Should we produce such research or statistical reports for external use, these reports will not contain any PI that identifies you; 
    ii. interacting with you via various means, including but not limited to: telephonically, post, email, SMS/MMS, social media and WhatsApp (“the Channels”). 
     
  3. We may monitor and record all phone calls and other interactions with you. 
  4. You have the right to lodge a complaint with the Information Regulator on +27 10 023 5200. Refer to our Privacy Statement. 

 

Direct Marketing 

 

  1. By signing up for the LCS Members Club, when employed by LCS, when becoming a member of LCS Members Club, or any later stage, to receive direct marketing from us, you authorize us to provide Marketing Services which includes marketing  information and promotional offers as per clause below (the “Marketing Services") from all of our brands, across all of the Channels. New channels may be added from time to time. When you opt-out of marketing from a particular Channel, you will be opted-out of the Channel for that brand that was communicating to you when you opted out. In order to opt-out of all Marketing Services (for all brands and channels), please contact Customer Services (the details in clause 2.5). It could take up to 48 (forty eight) hours for your updated election to take effect.
  2. We may market any of the Marketing Services to you on Saturdays, Sundays and public holidays and outside of prescribed times as set out in the Consumer Protection Act 68 of 2008 ("CPA"), but we will not do this if you opt-out. 
  3. Each time we send you Marketing Services via the Channels, we will give you the option to opt-out of receiving further Marketing Services via that Channel from that brand. 
  4. Please ensure that your contact details are kept up to date to ensure you receive Marketing Services, as we will not be held responsible if you do not receive personalised offers and information on limited time deals in the event that your contact details have changed. 
    a. Your PI, purchasing behaviour, online browsing behaviour, marketing permissions and LCS  Account and LCS  Members Club behaviour information, as visible to LCS , will be shared with selected third parties. These third parties will process your PI and other related information (set out in this clause) for the express purpose of: conducting analytics to develop insights; conducting marketing and product analysis; enhancing product offerings and developing new products that could be relevant to you; and marketing their services and products to you in a relevant way. Third parties may contact you in various ways including but not limited to phone, SMS, email, and direct mail. 
     b. You can contact Customer Services at any time to opt out of all third party data sharing and marketing. 

 

LCS  Members Club benefits 

 

  1. LCS Members Club members receive the following benefits: 
    a. exclusive access to LCS Members Club offers providing instant savings on selected goods in-store when you swipe; 
    b. personalised vouchers; and 
    c. entry to exclusive competition offers. 

 

Vouchers: 

 

  1. Vouchers will be issued to selected LCS Members Club customers in our sole discretion, indicating the available reward. 
  2. A voucher may only be used once. 
  3. Only one voucher may be redeemed per purchase. You may not accumulate vouchers or use multiple vouchers for one purchase. 
  4. All online vouchers have a minimum spend. If not expressly indicated, the minimum spend is the value of the voucher.  
  5. Vouchers will either be: 
    a. directly loaded on your card; 
    b. sent to you by SMS, WhatsApp or email; and/or 
    c. printed on your till slip when you purchase in-store; redeemable either in store or online or both, and across all or selected LCS brands. The voucher will include information regarding where and how it can be redeemed. 
  6. You may not redeem a voucher when purchasing the below items (unless specifically indicated): 
    a. sale, marked down or discounted items; 
    b. airtime, cellular, gift cards or services. 
  7.  The expiry date on a voucher will not be extended under any circumstances. 
  8. A voucher is not refundable if you return the product that was purchased using the Voucher. 
  9. We do not under any circumstances guarantee what the voucher reward will be and under no circumstances may you request a different reward, or obtain a second reward at the same time. 
  10. You will not be able to redeem a voucher in the unlikely event that a store is off-line, but will be able to redeem your voucher the next time that you shop.
